Please read these Terms carefully before using Tontine Fitness. By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Tontine Fitness is a skill-based mobile competition platform operated by Tontine Fitness, LLC ("Company," "we," "us," or "our"). The Service allows registered users to participate in step-count competitions, pay entry fees, and receive cash prizes based on competitive performance. Success in competitions depends primarily on the participant's sustained fitness effort, not on chance.
To participate in paid competitions, you must:
You represent and warrant that you meet all eligibility requirements. We reserve the right to verify eligibility and to disqualify or terminate accounts that do not comply. Void where prohibited.
Tontine Fitness uses Sign in with Apple for authentication. We do not create or store passwords. Your account security is managed by your Apple ID, which Apple protects with two-factor authentication and biometric verification.
You are responsible for all activity occurring under your account. You may not share accounts, create multiple accounts, or impersonate other users. Notify us immediately at support@tontinefitness.app if you suspect unauthorized account access.
Each competition requires participants to record a qualifying number of steps (typically 10,000) within each calendar day the competition is active. Steps must be recorded by Apple Health data sourced from hardware sensors (iPhone, Apple Watch, or compatible devices). Manually entered Health app data is excluded and does not count toward competition goals.
Any participant who fails to meet the daily step goal by midnight in their local device timezone is permanently eliminated from that pool. There are no exceptions, re-entries, or refunds for elimination due to missed goals, technical issues, device failure, or medical circumstances.
The last remaining non-eliminated participant wins the net prize pool. If multiple participants remain after all elimination conditions are satisfied, the net prize pool is split equally among survivors (a "Split" outcome).
If all remaining active participants fail to meet the daily goal on the same calendar day, the competition ends and the net prize pool is divided equally among participants who were active at that deadline.
Manipulating step data, exploiting application vulnerabilities, circumventing step-tracking, or any other form of cheating is strictly prohibited and will result in immediate account termination and forfeiture of any account balance.
Entry fees are collected via Apple Pay at the time you join a competition and are charged in US Dollars (USD). The total charge includes:
Entry fees are non-refundable once a competition has begun. If you are eliminated, you are not entitled to a refund. All payments are processed by Stripe, Inc. We do not store payment card details.
A platform maintenance fee is deducted from each competition's gross prize pool before distribution. The current fee schedule is disclosed in the app and may be updated with reasonable notice.
Winnings are credited to your in-app Vault Wallet balance after a competition concludes. You may withdraw your available balance to a linked bank account at any time, subject to a minimum withdrawal amount. Withdrawals are processed via ACH bank transfer (typically 2–3 business days, no withdrawal fee).
We reserve the right to withhold payouts pending identity verification or investigation of suspected fraud or Terms violations.
No purchase is required to participate. A free Alternative Method of Entry is available. To request free entry without payment, send a written request — including your name, registered email address, and the competition name — to amoe@tontinefitness.app at least 72 hours before the competition start time. One free entry per person per competition. All competition rules apply equally to AMOE participants.
You agree not to: create duplicate or fraudulent accounts; use automated tools or devices to inflate step counts; exploit application bugs; attempt to reverse-engineer or interfere with the Service; harass other users; use the Service for any illegal purpose; or circumvent geographic restrictions or eligibility requirements. Violations may result in immediate account termination and forfeiture of any balance.
All content, features, branding, and technology within Tontine Fitness are owned by Tontine Fitness, LLC or its licensors. You may not copy, reproduce, or distribute any part of the Service without prior written consent.
Tontine Fitness is a competition platform, not a medical or health service. We provide no medical advice. Consult a qualified healthcare provider before beginning any fitness program. We are not responsible for any injury or health condition arising from competition participation.
To the fullest extent permitted by law, Tontine Fitness, LLC and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the greater of (a) entry fees you paid in the 3 months preceding the claim, or (b) one hundred US dollars ($100).
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant uninterrupted, error-free, or secure operation of the Service.
You agree to indemnify and hold harmless Tontine Fitness, LLC and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorney's fees) arising from your use of the Service or your violation of these Terms.
Any dispute arising from these Terms shall be resolved by binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules, rather than in court. Class action lawsuits and class-wide arbitration are waived. The arbitrator's decision is final and binding.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.
You are solely responsible for reporting and paying all taxes applicable to prize winnings. We may issue tax forms (e.g., Form 1099) as required by applicable law. You agree to provide accurate tax identification information upon request.
You may delete your account at any time via Profile → Delete Account in the app. Deletion is permanent. Any remaining Vault Wallet balance must be withdrawn before deletion; unrecovered balances are forfeited. Contact support@tontinefitness.app if in-app deletion fails.
We may update these Terms at any time. Material changes will be communicated by updating the Effective Date and, where appropriate, by in-app notification. Continued use after the effective date constitutes acceptance of the updated Terms.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason at our discretion, with or without notice. Termination does not entitle you to a refund of entry fees, except as required by law.
