PLEASE READ THESE TERMS CAREFULLY. By downloading, accessing, or using Tontine Fitness, you agree to be bound by these Terms of Service. If you do not agree, do not use the application.
These Terms of Service ("Terms") govern your access to and use of the Tontine Fitness mobile application ("App") and related services operated by [Your Company Name], LLC, a Wyoming limited liability company ("Company," "we," "us," or "our"). By creating an account or participating in any competition, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them.
Tontine Fitness is a skill-based competitive fitness application. Users participate in step-count competitions ("Pools") where they must achieve a daily step goal to remain active. The last remaining active participant, or all remaining participants on an all-fail day, receives the prize pool. The App tracks steps via Apple HealthKit and Apple Watch integration.
You must be at least 18 years of age to participate in any paid competition. You must be a legal resident of a jurisdiction where skill-based competitions of this nature are permitted. You are solely responsible for determining whether participation is legal in your jurisdiction. The App is void where prohibited by law.
Each Pool requires a $20.00 USD entry fee paid via Coinbase Commerce at the time of joining. All entry fees are pooled together to form the gross prize pool. A 10% platform maintenance fee is deducted from the gross prize pool. The remaining 90% constitutes the net prize pool available for distribution to winner(s). This fee structure is disclosed within the application at the time of entry.
Fee Example: A pool with 10 participants ($200 gross) pays a $20 platform fee. The winner receives $180.
Daily Step Goal: Each participant must record a minimum of 10,000 steps per calendar day as tracked by Apple Health.
Elimination: Any participant who fails to meet the daily step goal is permanently eliminated from that Pool. There is no re-entry once eliminated.
Sole Survivor Win: The last remaining participant wins the net prize pool (90% of gross).
All-Fail Split: If all remaining active participants fail to meet the daily goal on the same calendar day, the net prize pool is divided equally among all participants who were active at the start of that day.
Weekly Pools: The Company creates weekly open pools every Monday at 9:00 AM Eastern Time. These pools start the following Monday and are open to all eligible users.
No purchase is required to enter a competition. A free alternative method of entry ("AMOE") is available. To enter without payment, mail a hand-written 3×5 index card with your full legal name, email address, and the pool name or start date to:

Mail-in entries must be received no later than 5 business days before the competition start date. One free entry per person per competition. Free entry participants are subject to all other competition rules.
Prize payouts are processed to the wallet address registered in your profile. It is your sole responsibility to provide and maintain an accurate payout wallet address. The Company is not responsible for funds sent to an incorrect address provided by you. Payouts are processed within 5 business days of competition conclusion.
Step data is sourced exclusively from Apple HealthKit. The Company relies on Apple's platform for step data accuracy. Users may not manipulate, spoof, or artificially inflate step counts. Suspected manipulation will result in immediate disqualification and permanent account termination without refund.
Entry fees are non-refundable once a competition has started. If a competition is cancelled before the start date due to insufficient participants, entry fees will be refunded in full via the original payment method within 10 business days.
You agree not to: use automation, bots, or third-party tools to manipulate step counts; create multiple accounts; attempt to exploit bugs or vulnerabilities; harass other users; violate any applicable law or regulation; or use the App in any jurisdiction where it is prohibited.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. THE COMPANY DOES NOT GUARANTEE UNINTERRUPTED SERVICE, DATA ACCURACY, OR SPECIFIC COMPETITION OUTCOMES. PARTICIPATION IN COMPETITIONS INVOLVES RISK, INCLUDING THE RISK OF LOSING YOUR ENTRY FEE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID IN ENTRY FEES IN THE 30 DAYS PRECEDING THE CLAIM.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration in Wyoming, except that either party may seek injunctive relief in any court of competent jurisdiction.
We reserve the right to modify these Terms at any time. We will notify users of material changes via the App or email. Continued use of the App after changes constitutes acceptance of the revised Terms.
